Unpaid leave is leave given to the employees without salary, according to the period of the leave taken. In Indonesia, unpaid leave can be given for various reasons, so long not regulated in the labor law (UU Ketenagakerjaan No. 13 Tahun 2003) as the paid leave types. Commonly, unpaid leave is given for personal or family reasons, which take more days than annual leave such as scholarship or vacations abroad.
Unpaid leave really needs a two way agreement between the employer and the employee. The employer agrees to keep the employment and when letting the employee take the leave for a longer period of time than its annual leaves, while the employee agrees not to be paid while taking the leave.
Not like the paid leaves, unpaid leave is not mandatory to the employers. An unpaid leave request from the employee can be rejected by the employer without any legal consequences.
